The situation in Gibraltar as it stands right now (December 2020) is that abortion is a criminal offence punishable with life imprisonment for both the mother and the doctor performing the procedure or administering abortive medicine. A person procuring said drugs is also liable on conviction to up to 5 years imprisonment. The law only allows a defence of protecting the maternal life. The Government of Gibraltar has inscribed into law the Crimes (Amendment) Act 2019 (see https://www.gibraltarlaws.gov.gi/uploads/legislations/crimes/2019-19.pdf#viewer.action=download). This piece of legislation is contained within the Crimes Act 2011. Thus abortion in Gibraltar is still criminalised. It is currently NOT IN FORCE. It will only come into force upon a positive result in a referendum on this Act. The referendum was meant to take place on 19th March 2020 but was deferred as a result of the Coronavirus pandemic. As of December 2020 no date has been fixed for the Referendum to take place. As you can see in the excerpt below:

The Crimes (Amendment) Act 2019 is very similar to the UK Abortion Act 1967. The main change has been reducing from 24 weeks to 12 weeks for terminations in which “…continuance of the pregnancy would involve risk, greater than if the pregnancy were terminated, of injury to the physical or mental health of the pregnant woman.” The other main change has been to remove the financial reasons (with no time limit) from list of allowed reasons.
